Lire la suite >By including CSR criteria in a series of public procurement contracts between 2011 and 2017, Nantes Métropole has been pioneer in responsible public procurement. But the French Council of State sanctioned the device in 2018. The article questions Nantes Métrople's territorial public policy of CSR and shows that the latter allowed public actors to redefine the methods of assessment of their suppliers, on the basis of a pluralistic and co-constructed grid of CSR criteria, with the support of local socioeconomic networks. But the decision of the Council of State recalled the supremacy of the principle of competition on the stakes of sustainable development in the hierarchy of standards and it exposes, at the same time, the role of the public procurement code as an instrument of the regime of total performance. A real consideration of sustainability imperatives would therefore imply new, as well as more ambitious evolutions of the regulatory framework.Lire moins >
